Bava Basra 103

BAVA BASRA 101-105 - Sponsored by a generous grant from an anonymous donor. Kollel Iyun Hadaf is indebted to him for his encouragement and support and prays that Hashem will repay him in kind.

1) [line 3] "[V'IM GA'OL YIG'AL ES HA']SADEH [HA'MAKDISH OSO]" - "[If he will redeem the] field, [the person who sanctified it...]" (Vayikra 27:19)

2) [line 4] "... ZERA CHOMER SE'ORIM BA'CHAMISHIM SHEKEL KESEF." - "[And if a man shall sanctify to HaSh-m some part of a field of his possession, then the endowment value shall be according to its seed;] each Chomer of barley seed [that the field can grow] shall be valued at fifty Shekels of silver." (Vayikra 27:16)

3) [line 10] LESECH / SE'AH / TARKAV - these are various measurements of a field, based on the amount of seed that can be sown in them (MEASUREMENTS OF VOLUME / AREA)

  • 1 Kor (= 1 Chomer) = 30 Se'in
  • 1 Lesech = 15 Se'in
  • 1 Eifah = 3 Se'in
  • 1 Se'ah = 6 Kabin
  • 1 Tarkav (= 3 Kabin) = 12 Lugin
  • 1 Kav = 4 Lugin
  • 1 Log (= 1 Rova) = 4 Revi'iyos = 6 Beitzim
  • 1 Beitzah = 2 k'Zeisim
4a) [line 11] NAGANEI D'AR'A - cracks of the land
b) [line 11] SHIDREI D'AR'A - bumps (like the spine) of the land

5) [line 19] TERASHIM SHE'AMRU - the rocks (rocky terrain) which they (in the Mishnah) said [are included in the measure of the land when they are less than 10 Tefachim high, are only included when their total area is less than Beis Arba'as Kabin]

6a) [line 20] BEIS ARBA'AS KABIN - an area of four Kav (in which four Kav of seed can be planted)
b) [line 21] CHAMESHES KABIN - an area of five Kav

7) [last line] TEIKU The Pri Megadim (in his Igeres preceding his introduction to Orach Chaim, #9) quotes and discusses various explanations for the word Teiku:

  1. It is sealed in its container ("Tik") (ARUCH, Erech Tik).
  2. Tehei Ka'i - "Let it (the question) stand" (MUSAF HA'ARUCH).
  3. Tishbi Yetaretz Kushyos v'Ibayos - "Eliyahu ha'Navi will answer difficulties and questions" (TOSFOS YOM TOV, end of Eduyos).
103b---------------------------------------103b

8a) [line 1] K'SHEIR - [in a circle] like a bracelet (RASHI to Bava Metzia 25a, RASHBAM here)
b) [line 1] K'SHURAH - in a line
c) [line 1] ITZTADININ - (a) [like the shape of the horns of] a stadium bull (RASHBAM; see diagram in Rashbam. The ME'IRI describes the shape as a semi-circle); (b) [like the spread of the front feet of] a stadium bull [when it prepares to gore] (first explanation of RE'EM in Shitah Mekubetzes). (It is interesting to note that the word "stadium" (Greek) refers to the terraced structure surrounding an ancient Greek running track and "typically built in the shape of a long narrow horseshoe" (Webster).)
d) [line 1] DERECH AKALASON - in the form of a diagonal (see diagram in Rashbam)

9) [line 4] MEITZAR - [adjacent to the field's] border
10) [line 6] TZUNMA - hard rock
11) [line 7] BEIS KOR AFAR ANI MOCHER LACH MIDAH B'CHEVEL - I am selling to you a Beis Kor of land, measured by the [measuring] rope

12) [line 9] YENAKEH - he shall deduct [the value of the missing land from the price that the buyer pays him]

13) [line 9] HEN CHASER V'HEN YASER - whether there is a little extra or a little lacking (HEN CHASER HEN YASER)
(a) The Mishnah teaches that when a person sells land and specifies that he is selling an exact amount, if he inadvertently gives more land than the specified amount, then the buyer must give him back that extra land (or rather pay him for it, as the Chachamim instituted for the benefit of the seller). If the seller inadvertently gives less land than the specified amount, then he must give back part of the money to the buyer.
(b) If, however, when he sells the land, the seller specifies an amount and says "more or less," then if he inadvertently gives more land that the specified amount, the transaction is binding and the buyer need not reimburse the seller for the extra land. Similarly, if he inadvertently gives less land that the specified amount, the transaction is binding and the seller need not reimburse the buyer.
(c) The Mishnah specifies that this is true only when the extra (or missing) amount of land is equal to or less than a quarter of a Kav per Se'ah of land (1/24th). If the extra land is more than that amount, then the party who is losing must be reimbursed.

14) [line 14] BEIS TISH'AH KABIN - an area of nine Kav (in which nine Kav of seed can be planted). Nine Kav is the minimum size of a field, as the Mishnah teaches on Daf 11a.

15) [line 15] GINAH - a garden. The minimum size of a garden is a half of a Kav according to the Chachamim, or a fourth of a Kav according to Rebbi Akiva (Daf 11a).

16) [line 15] BEIS CHATZI KAV - an area of half of a Kav (see previous entry)

17) [line 16] BEIS ROVA - an area of a fourth of a Kav (see entry #15)
