Kesuvos 3

KESUVOS 2 & 3 - Generously dedicated by Reb A. Wolfson, a sincere Ohev Torah and Mokir Torah and himself an example of Torah u'Gedulah b'Makom Echad.

1)

(a) How can the Rabbanan validate a Get that min ha'Torah, is not valid?

(b) Why is this easily understood by Kidushei Kesef, but not by Kidushei Bi'ah?

(c) How do we then explain it, even by Kidushei Bi'ah?

2)
In the second Lashon, Rava compares Gitin to Kidushin ('Yesh O'nes be'Gitin' ). We deal with the three cases that we cited in the first Lashon using reverse arguments (what was before a proof, is now a Kashya ... ).
How will we explain the Mishnah in Gitin ...
1. ... 'Im Lo Ba'si mi'Kahn ve'ad Sh'neim-Asar Chodesh, u'Meis be'Toch Sh'neim-Asar Chodesh, Ein Zeh Get' (implying 'Chalah, Harei Zeh Get')?
2. ... 'me'Achshav im Lo Ba'si mi'Kahn ve'ad Sh'neim-Asar Chodesh, u'Meis be'Toch Sh'neim-Asar Chodesh, Harei Zeh Get' (and we assume, 'Hu ha'Din le'Chalah')?
3)
(a) Rav Shmuel bar Yitzchak states that the Din in our Mishnah 'Besulah Niseis' applies only to the era of Ezra and onwards, when Beis-Din began convening on Monday and Thursday, but not before.
What is the point of telling us this? What has passed, has passed?

(b) So when may a Besulah get married nowadays?

(c) What happened to Takanas 'Shakdu'?

(d) Why do we need to ask 'Mai Shakdu?' and then to cite a Beraisa, considering that earlier, we cited Shmuel?

Answers to questions

4)

(a) On which day did the people adopt the custom to get married in the time of danger? What was the Chachamim's reaction to this?

(b) Under which circumstances did they permit them to marry even on Monday?

(c) The same Beraisa informs us that they would separate the Chasan and Kalah (if she was a Besulah) on Friday night.
Why, and under which circumstances did they do this?

5)
(a) Why can the time of danger not refer to a decree that anyone who married on Wednesday would be killed?

(b) Then which decree does it refer to?

(c) If it is referred to as 'danger' because of the Tz'nu'os who gave up their lives rather than acquiesce to such a terrible decree, why did they not just teach them that O'nes is permitted? Which two types of women did they have in mind when they preferred to let the people unofficially change the Minhag?

(d) Then why did they not revoke the Takanah of 'Besulah Niseis ... ' in face of the decree?

6) What made the women so certain that if they married on Tuesday, they were safe from the decree?

7)

(a) The Tana of the Beraisa permits the Besulos to marry even on Monday when there is an O'nes.
Why can this not be referring to the decree of which we spoke earlier?

(b) So how does Rava interpret it? Why is that a reason to permit the Besulos to marry on Monday (What are we afraid of)?

(c) Why do we not just postpone the wedding until the following Wednesday?

(d) Why do we permit them to marry already on Monday? Why not wait until Tuesday?

8)
(a) In a second explanation, we interpret O'nes to mean that the Chasan's father or the Kalah's mother died on Monday.
Why do we then permit them to marry on Monday?

(b) What is then the procedure? What happens to the deceased in the interim?

(c) When do the Chasan and Kalah then begin their period of mourning?

(d) Does it make any difference whether it is the father of the Chasan and the mother of the Kalah, or vice-versa, who dies?

9) Seeing as the seven days of rejoicing over-ride the seven days of mourning, why do we obligate the Chasan and Kalah to sleep separately?
