Kesuvos 14

KESUVOS 11-14 - have been anonymously dedicated by a unique Ohev Torah and Marbitz Torah living in Ramat Beit Shemesh, Israel.

1)

(a) An engaged couple came before Rav Yosef. Both agreed that she was pregnant from him. Rav Yosef accepted their testimony on the grounds that they both agreed.
Why would he have accepted it even if the man had denied being the father of the baby?

(b) On what grounds did Abaye query Rav Yosef's ruling in this case?

(c) How did Rav Yosef nevertheless justify it?

2)
(a) Assuming 'Almanas Isah' to be a S'fek S'feika' (like Rav Yosef Tuv Ileim), what is an Almanas Isah'?

(b) What Rebbi Yehoshua and Rebbi Yehudah ben Beseira rule in the case of Almanas Isah?

(c) How do we reconcile this ruling with Rebbi Yehoshua's own ruling in our Mishnah, where he does not believe the woman who says that the man she had been 'talking to' was a Kohen?

(d) We retract from this answer however, in light of the fact that Raban Gamliel's two rulings also appear contradictory. How do we reconcile ...

  1. ... Raban Gamliel, who believes the woman in our Mishnah, but not an Almanas Isah?
  2. ... Rebbi Yehoshua (finally), who believes her by Almanas Isah but not in our Mishnah?
3)
(a) Why is the case currently under discussion called 'Almanas Isah'?

(b) What is the significance of Safek Mamzeirus, Nesinus and Avdei Melachim with regard to Almanas Isah?

(c) What exactly, is 'Avdei Melachim'?

4)

(a) What do we initially infer (with regard to a Safek Chalal) from the Tana's exclusive list (of the three above-mentioned P'sulim - Safek Mamzeirus, Nesinus and Avdei Melachim)?

(b) Why is the Tana's distinction between Safek Chalal and other cases of Safek P'sul difficult to understand?

(c) What is also the problem with Rebbi Meir, who says in the Beraisa 'Kol she'Ein Bah Echad mi'Kol Eilu, Masi'in li'Kehunah'?

(d) The Tana also writes 've'Chein Amar Rebbi Shimon ben Elazar Amar Rebbi Meir ki'D'varav'.
What does he go on to say with regard to Almanas Isah, that contradicts the Tana Kama in Rebbi Meir?

5)
(a) Rebbi Yochanan establishes the triple Machlokes in the Beraisa on two issues (Chalal Shosek and Mamzer Tzovei'ach). Rebbi Meir and the Tana Kama argue over Chalal Shosek. The Tana Kama permits Almanas Isah to marry li'Kehunah provided Mamzeirus, Nesinus and Avdei Melachim are not included in the Safek.
What is the reason for these being Pasul? What is the case?

(b) What will he therefore hold in a case where Safek Chalal is included too?

(c) Rebbi Meir declares her Kasher li'Kehunah in the case of a Safek Chalal. Why is that?

6)
(a) Rebbi Shimon ben Elazar Amar Rebbi Meir disagrees with the Tana Kama quoting Rebbi Meir in a number of points.
What does he say with regard to ...
  1. ... a Chalal ve'Shosek?
  2. ... a Mamzer ve'Shosek?
(b) Which cases of Safek Chalal does he agree is Kasher?

(c) What does he hold in the case of Mamzer ve'Tzovei'ach?

7)
(a) What did Rebbi Yochanan ben Nuri rule regarding the girl who was raped when she went down to the well to draw water from the spring?

(b) What problem does Rava have with Rebbi Yochanan ben Nuri's ruling?

(c) Rav Nachman establishes the ruling in accordance with Rebbi Yehoshua, and he speaks 'bi'K'ronos shel Tzipori Hayah Ma'aseh'.
What does he mean by that?
