Nazir 13

NAZIR 13 (1 Cheshvan) - l'Iluy Nishmas ha'Ga'on Rav Gedalya Rabinowitz (of Manchester and, towards the end of his life, Bnei Brak), well-remembered for his spirited Shi'urim that kindled many a heart with the fire of Torah.

1) NEZIRUS OUT OF GRATITUDE

(a) If his wife miscarried, he is not a Nazir; R. Shimon says, he stipulates: if the baby was viable, my vow compelled me to be a Nazir; if it was stillborn, I now accept to be a Nazir.
(b) If his wife later gave birth, he is a Nazir; R. Shimon says, he stipulates: if the 1st baby was viable, I was before a Nazir because of my vow; now, I accept to be a Nazir;
1. If the 1st baby was stillborn, my 1st Nezirus was voluntary, and now I am a Nazir because of my vow.
(c) (Gemara) Question: Obviously, if a son is born, he is a Nazir, as he vowed!
(d) Answer: The Mishnah must teach that he is not a Nazir if a girl, Tumtum or Androginus is born.
1. One might have thought, when he said 'When I have a Ben (son)', his intention was 'When Evneh (I will be built, i.e. have children)' - we hear, this is not so.
(e) (Mishnah): 'I will be a Nazir when I have a child' - even if a girl, Tumtum or Androginus is born, he is a Nazir;
(f) Question: This is obvious!
(g) Answer: One might have thought, his intention was for a child that people consider important, i.e. a son - we hear, this is not so.
(h) (Mishnah): If his wife miscarried, he is not a Nazir.
(i) Question: Who is the Tana of the Mishnah?
1. Answer: R. Yehudah as in the Beraisa of the stack.
i. (Beraisa): 'I am a Nazir on condition that this stack is at least 100 Kor'; the stack was lost or stolen before he was able to measure it. R. Shimon says, one must be stringent in a doubtful case of Nezirus; R. Yehudah says, we are lenient in a doubtful case of Nezirus, he is not a Nazir.
(j) (Mishnah): R. Shimon says, he stipulates: if the baby was viable, my vow compelled me to be a Nazir; if it was stillborn, I now accept to be a Nazir.
(k) Question (R. Aba): 'I will be a Nazir when I will have a son'. His wife miscarried, he separated a sacrifice, and his wife gave birth - what is the law?
1. Question: According to whom is the question?
i. If according to R. Shimon - he says, one must be stringent by a doubtful case of Nezirus - clearly, the animal becomes sanctified!
2. Answer: The question is according to R. Yehudah, who says that we are lenient by a doubtful case of Nezirus; is the animal sanctified?
i. If it is, one may not shear nor work with it.
(l) This question is unresolved.
2) ACCEPTING NEZIRUS FOR ANOTHER PERSON'S GOOD FORTUNE
(a) Question (Ben Rechumei): Reuven said, 'I will be a Nazir when I will have a son'; Shimon heard, and said 'And it is upon me'. Does Shimon refer to the words of Reuven (and when Shimon has a son, he is a Nazir), or to Reuven himself (and when Reuven has a son, Shimon is a Nazir)?
1. Question: If he refers to Reuven himself - what if Shimon said 'And I'? (Other texts: What if Reuven said, 'I will be a Nazir when you will have a son'; Shimon heard, and said 'And I').
i. Does Shimon refer to himself; (and when Shimon has a son, he is a Nazir); or, to the words of Reuven (and when Reuven has a son, Shimon is a Nazir), to show that he loves Reuven just as Reuven loves him?

(b) Question: If whenever Reuven is there, we say that Shimon is embarrassed (and we construe his words as accepting Nezirus when Reuven will have a son) - what if Reuven said, 'I will be a Nazir when Ploni will have a son'; Shimon heard, and said 'And I'.
1. Do we say, since Ploni is not there - Shimon refers to himself; or, is he showing that he also loves Ploni (and when Ploni has a son, Shimon is a Nazir)?
i. This question is unresolved.
3) OVERLAPPING NEZIRIYOS
(a) (Mishnah): 'I am a Nazir, and I will be a Nazir when I have a son'. He started conducting Nezirus, and had a son - he finishes his Nezirus, then conducts the Nezirus he accepted for birth of the son.
(b) 'I will be a Nazir when I have a son, and I am a Nazir'. He started conducting Nezirus, and had a son - he leaves his Nezirus, conducts the Nezirus he accepted for birth of the son, then completes his Nezirus.
(c) (Gemara - Rava) Question #1: 'I will be a Nazir after 20 days, and I am a Nazir from now for 100 days' - what is the law?
1. Since 100 days do not fit into 20, the 100-day Nezirus does not take effect (until after finishing the Nezirus after 20 days).
2. Or, since 80 days remain, and he will have more than the 30 days growth of hair needed to shave when bringing his sacrifices, it takes effect right away.
i. Question: Why didn't Rava ask about accepting a short (i.e. 30 day) Nezirus (after having accepted Nezirus after 20 days)?
ii. Answer: In truth, he asked about a 100-day Nezirus after asking about short Nezirus.
