Nazir 15

1) NEZIRUS AFTER THE TERM

(a) Answer: Tum'ah is different, since it says, "He defiled the head of his Nezirus" - this refers to one whose Nezirus depends on his head (i.e. until he shaves).
(b) Question (Beraisa): A Nazir that finished his term is forbidden to shave, drink wine, or become Tamei; if he did any of these, he is lashed.
1. This refutes R. Yosi bar Chanina.
2) OVERLAPPING NEZIRIYOS
(a) (Mishnah): 'I will be a Nazir when I have a son; I am a Nazir 100 days'. If he had a son within 70 days of saying this, he does not lose any of the days counted; after 70 days, he loses 70 (Tosfos (13B) deletes '70' from the text), since shaving requires 30 days growth of hair.
(b) (Gemara - Rav): The 70th day counts for both Neziruyos.
(c) Question (Mishnah): If he had a son within 70 days of saying this, he does not lose any of the days counted.
1. If the 70th day counts for both - not only does he not lose, he profits!
(d) Answer: Really, it should not say 'until 70' - it says this because the end of the Mishnah says 'after 70, he nullifies', the beginning of the Mishnah says '70'.
(e) Question (Mishnah): If a son is born after 70 days, he loses (we do not say, day 71 counts for both!)
(f) Answer: 'After 70' means, after the day after 70, i.e. 72.
(g) Objection: But day 71, he would not lose? If so, the beginning of the Mishnah should say, until 71 days, he does not lose!
1. Rather, it must be, 'after 70' really means '71'; the Mishnah opposes Rav.
3) AS WHOM DOES RAV HOLD
(a) Question: Rav must have said his law as another Tana - which one?
(b) Answer #1: Rav holds as Aba Shaul.
1. (Mishnah): If 3 days passed from burial before Yom Tov, the mourner is exempt from the restrictions of the rest of the 7 days of mourning;
2. If burial was 8 days before Yom Tov, he is exempt from the restrictions of the rest of the 30 days of mourning, and he is allowed to shave on Erev Yom Tov; if he did not shave on Erev Yom Tov, he may not shave after Yom Tov (for the rest of the 30 days);

3. Aba Shaul says, even if he did not shave on Erev Yom Tov, he may shave after Yom Tov;
i. Just as fulfilling 3 days of mourning nullifies the rest of the 7, also 7 days nullifies the rest of the 30.
(c) Question: What is Aba Shaul's reason?
1. Suggestion: The 7th day counts both as part of the 7, and as part of the 30.
2. Objection: Perhaps Aba Shaul only said this by the 7 days of mourning, which is Rabbinic, but he would not say this by 30 days of Nezirus, which is mid'Oraisa!
(d) Answer #2: Rav holds as R. Yosi.
1. (Mishnah - R. Yosi): The Korban Pesach was slaughtered for a Shomeres Yom k'Neged Yom (a woman on the morrow of seeing pre-menstrual blood), and she later saw blood that same day. She cannot eat the Pesach at night, but she is exempt from Pesach Sheni (the compensatory sacrifice for one that did not fulfill Korban Pesach).
(e) Question: What is R. Yosi's reason?
1. Suggestion: He holds, part of the (2nd) day (before she saw blood) is as a full day; she only becomes Teme'ah from the time she saw blood.
(f) Objection: Does R. Yosi really hold thusly?
1. (Beraisa - R. Yosi): The Korban Pesach was slaughtered for a Zav that had 2 emissions on the 7th day (from his last emission) and a Shomeres Yom k'Neged Yom; later, each had another sighting. Even though they retroactively impart a severe Tum'ah (if they sat on) vessels meant to be sat on, they are exempt from Pesach Sheni.
(g) Answer: The retroactive Tum'ah is mid'Rabanan (mid'Oraisa, they are only Tamei from the time they see).
1. Support: This must be so - if not, they would be obligated to bring Pesach Sheni!
2. Rejection: The retroactive Tum'ah can be mid'Oraisa - Tum'as ha'Tehom (a Tum'ah that one who could not have known about) of emissions does not obligate a person to bring Pesach Sheni.
(h) R. Oshiya also holds that the retroactive Tum'ah is mid'Rabanan.
1. (Beraisa - R. Oshiya): A Zav that has an emission on the 7th day (from his last emission) wipes out the days he counted without an emission.
2. R. Yochanan: It should only nullify the 7th day itself.
i. Objection: This is illogical! If it nullifies the day - it should nullify the entire count; if not, the count should be complete!
3. Correction: Rather, R. Yochanan says that even the 7th day counts.
