Nazir 16

1) RETROACTIVE TUM'AH

(a) R. Oshiya: R. Yosi holds as you do, that he is only Tamei from when he sees.
(b) Question: But R. Yosi said, they impart Tum'ah retroactively!
(c) Answer: This is only mid'Rabanan.
(d) Question: If R. Yosi holds that part of a day counts as a day - how can a woman see blood 3 consecutive days, to bring a sacrifice?
1. The first part of the 2nd (or 3rd) day, before she saw, should count as an intervening clean day!
(e) Answer #1: Blood was flowing for 3 full days.
(f) Answer #2: 3 consecutive nights, she saw at the start of the evening, so there was no time to count as a day.

2) THE END OF NEZIRUS

(a) (Mishnah): Reuven said, 'I am a Nazir' - he shaves (and brings the sacrifices of a Nazir) on the 31st day; if he shaved on day 30, he fulfilled his obligation;
(b) If he said 'I am a Nazir for 30 days', and shaved on day 30, he did not fulfill his obligation;
(c) One who accepted twice to be a Nazir - he shaves for their completion on day 31 and day 61; if he shaved for the 1st on day 30, he shaves for the 2nd on day 60; if he shaved on day 59, he fulfilled his obligation.
1. R. Papiyus testified to this law; the reason is, the 30th day is counted.
(d) Reuven said, 'I am a Nazir'; if he became Tamei on day 30, this nullifies all the days he counted; R. Eliezer says, only 7 days are lost;
(e) If he said 'I am a Nazir for 30 days', and became Tamei on day 30, this nullifies all the days;
(f) 'I am a Nazir 100 days'; if he became Tamei on day 100, this nullifies all the days; R. Eliezer says, only 30 days are lost;
1. If he became Tamei on day 101, this nullifies 30 days; R. Eliezer says, only 7 days are lost.
(g) (Gemara - Mishnah): Reuven said, 'I am a Nazir'; if he became Tamei on day 30, this nullifies all the days he counted; R. Eliezer says, only 7 days are lost.

(h) R. Eliezer holds, one who becomes Tamei after completing the term of Nezirus loses 7 days.
(i) Question (Mishnah): If he said 'I am a Nazir for 30 days', and became Tamei on day 30, this nullifies all the days, and R. Eliezer does not argue!
(j) Answer: (It is as if) he said complete days.
(k) Question (Mishnah): 'I am a Nazir 100 days'; if he became Tamei on day 100, this nullifies all the days; R. Eliezer says, only 30 days are lost;
(l) Answer: As we answered on Dapim 5 and 6, according to Bar Pada and Rav Masna.
3) ACCEPTING NEZIRUS WHEN TAMEI
(a) (Mishnah): Reuven was in a cemetery and accepted Nezirus. Even if he stayed there 30 days, they do not count, and he does not bring the sacrifices of a Nazir that became Tamei;
(b) If he left (and became Tahor) and returned to the cemetery, the days are counted, and he brings the sacrifices of a Tamei Nazir;
1. R. Eliezer says, if he returned on the day he became Tahor, he does not bring the sacrifices.
i. "The first days will fall" - the sacrifices only apply if there were (at least 2) first days.
(c) (Gemara): Reuven was in a cemetery and accepted Nezirus.
1. (R. Yochanan): Nezirus takes effect on him.
i. He holds, the Nezirus is hanging - it takes effect now, and when he becomes Tahor, it takes effect (fully).
2. (Reish Lakish): Nezirus does not take effect on him.
i. He holds, it does not take effect unless he accepts Nezirus again when he is Tahor.
(d) Question (R. Yochanan - Mishnah): Reuven was in a cemetery and accepted Nezirus. Even if he stayed there 30 days, they do not count, and he does not bring the sacrifices of a Nazir that became Tamei.
1. We infer, he does not bring the sacrifices, but the Nezirus takes effect!
(e) Answer: No, the Mishnah says that the laws of Tum'ah and sacrifices do not apply to him.
(f) Question (Beraisa): A Tamei person accepted Nezirus. He is forbidden to shave, drink wine, or become Tamei; if he did any of these, he receives 40 lashes.
1. We understand, if Nezirus took effect, that is why he is lashed.
2. If it did not take effect - why is he lashed?
