Nazir 41

NAZIR 41 & 42 - sponsored by Harav Ari Bergmann of Lawrence, N.Y., out of love for Torah and those who study it.

1) A LEPER MUST SHAVE WITH A RAZOR

(a) Answer #2: If he fulfills his Mitzvah with a tweezers or planing tool, since the Torah did not specify razor - Reish Lakish's law would show that he may not use a razor!
1. (Reish Lakish): Wherever you find an Aseh and a Lav - if you can fulfill both, fine; if not, the Aseh overrides the Lav.
(b) Question: How does R. Eliezer learn that a leper shaves with a razor?
(c) Answer: He learns from "His head".
1. (Beraisa): It says by a Nazir, "A razor will not pass over his head". One might have thought, this applies even if he is a leper - the Torah says "His head" (that a leper shaves even if he is a Nazir).
(d) Question: Perhaps a leper can also fulfill his Mitzvah with a tweezers or plane!
1. "His head" comes to teach that he is allowed to shave with a razor.
i. One would have thought that a Nazir is liable for shaving with a razor, even when he is a leper - we hear, this is not so.
(e) Answer: If he fulfills his Mitzvah with a tweezers or plane, since the Torah did not specify razor - Reish Lakish's law would teach that he may not use a razor!
2) HOW THE OTHER VERSE IS EXPOUNDED
(a) Question: What do Chachamim learn from "His head"?
(b) Answer: That the Mitzvah for a leper to shave overrides the prohibition of cutting the Pe'os of the head.
1. (Beraisa): "Do not round the corners of the head" - one might have thought, this applies even to a leper - the Torah says "His head".
(c) Question: Why did the Torah one might have to write "His head" - we should learn from "His beard"!
(d) Answer (Beraisa): "(Kohanim) will not shave the corners of their beards" - one might have thought, even a leper - the Torah says "His beard".
(e) Question: Why did the Torah have to write "His head" - and "His beard"?
(f) Answer: Had the Torah only written "His beard", one might have thought that "Do not round the corners of the beard" does not apply when he shaves all his hair - therefore, the Torah wrote "His head".
41b---------------------------------------41b

(g) If the Torah only wrote "His head" - one would have learned 2 laws.
1. An Aseh overrides a Lav;
2. "Do not round the corners of the beard" applies when he shaves all his hair.
i. This would not teach us that a leper must shave with a razor - therefore, "His beard" is also needed.
(h) Question: What is R. Eliezer's source that an Aseh overrides a Lav?
(i) Answer: He learns from Tzitzis.
1. (Beraisa): "Do not wear Sha'atnez" - but you may make Tzitzis from Sha'atnez.
