Nedarim 5

NEDARIM 2,3,4,5 - dedicated by Uri Wolfson and Naftali Wilk in honor of Rav Mordechai Rabin of Har Nof, a true beacon of Torah and Chesed.

1) [line 1] HEIMECHA - from you (this has the same connotation as "Mimcha" of the Mishnah)

2) [line 3] HAREINI ALECHA CHEREM - my possessions are (lit. I am) to you as Charamim (see Background to Nedarim 2:2), [and you may not benefit from them] (the Tana of this Mishnah follows the opinion of the inhabitants of the Galil, who held that unspecified pledges of Cherem were consecrated to Bedek ha'Bayis)

*3*) [line 11] MUDRANI HEMECHA, HU ASUR V'CHAVERO MUTAR - according to the Ran, until now we thought that Shmuel stated that "Mudrani Mimecha" must be pronounced together with "she'Ani Ochel Lecha" because "Mudrani Mimechah" alone has no connotation of Isur. However, at this point the Gemara is suggesting a new approach. Shmuel agrees that if one says just "Mudrani Mimecha" the Neder *does* take effect, although it takes effect in a different manner than when one pronouncing it together with "she'Ani Ochel Lecha." However, Shmuel insists that the Mishnah is discussing a person who said the two statements together because of an inference from the Mishnah, which does not say "Asur" between the two statements, implying that they are really one joint statement. The Gemara is only left to explain in what way the Halachah would be different had the person *only* said "Mudrani Mimecha."

4) [line 25] LO MISHTA'INA BAHADACH - I will not talk to you (the Neder would apply to the mouth of the Madir, as in the Mishnah on Daf 13b)

5) [last line] D'LO KA'IMNA - I will not stand (the Neder would apply to the feet of the Madir, as in the Mishnah on Daf 13b)

5b---------------------------------------5b

6a) [line 5] V'DEIN DI'YEHEVEI LICHI MINAI - and this [document] that will be to you from me
b) [line 6] SEFER TEIRUCHIN - a record of being sent away
c) [line 6] V'IGERES SHEVUKIN - and a document of release

*7*) [line 6] AMAI DACHIK SHMUEL L'UKUMAH L'MASNISIN K'REBBI YEHUDAH - The Gemara wants to know why Shmuel insisted on explaining the Mishnah like Rebbi Yehudah, that a person must *also* say "she'Ani Ochel Lecha" and not just "Mudrani Mimecha." Even though the Ran explained earlier (5a DH Ela) that Shmuel learned this from the fact that the Mishnah says the word "Asur" only once (see entry #3), that is not a very strong inference. The Gemara is therefore looking a *better* proof that the Mishnah holds that "Mudrani Mimecha" must be pronounced together with "she'Ani Ochel Lecha." (SHALMEI NEDARIM)

8) [line 16] HAFLA'AH - a distinct utterance (where there is no doubt as to its meaning)
9) [line 20] GET PETURIN - a bill of divorce
10) [line 24] D'VA'INAN KERISUS V'LEIKA - where there needs to be a separation between them and there is not [in the case of Yadayim she'Ein Mochichos, i.e. without the phrase, "v'Dein..."]
