Nedarim 56

NEDARIM 56 - This daf has been dedicated l'Iluy Nishmas Esther Chaya Rayzel (Friedman) bas Gershon Eliezer, mother of Jeri Turkel, Marcia Weinblatt and Moshe Smulevitz, after the completion of the Shiv'a (Yahrzeit: 1 Elul). She was a woman of valor who was devoted to her family and gave of herself unstintingly, inspiring all those around her.

1) WHAT IS PART OF A HOUSE?

(a) (Mishnah - R. Meir): One who vows from a house is permitted the 2nd story; Chachamim say, the 2nd story is part of the house;
(b) One who vows from the 2nd story is permitted in the house.
(c) (Gemara) Question: Who is the Tana of the following?
1. (Beraisa): "In the house" - this includes a colored house, and the 2nd story.
(d) Answer #1 (Rav Chisda): It is R. Meir - Chachamim say that the 2nd story is considered part of the house, they would not need a verse to include it!
(e) Answer #2 (Abaye): It can even be as Chachamim.
1. One might have thought that "A house of the land of your inheritance" teaches that it must be connected to the ground, to exclude the 2nd story - "In a house" teaches, this is not so.
(f) Question: As whom is the following teaching?
1. (Rav Huna Bar Chiya): I sell you a house among my houses - he may give him an Aliyah (2nd story).
i. Only because he said, 'A house among my houses' - had he just said 'a house', he could not give him a 2nd floor!
2. Suggestion: It is as R. Meir.
(g) Answer: It can even be as Chachamim - Aliyah does not mean 2nd story, rather, Me'ulah (the best) of houses.
2) WHAT IS A BED?
(a) (Mishnah - R. Meir): One who vows from a bed is permitted a Dargash; Chachamim say, Dargash is included in the term bed;
(b) One who vows from a Dargash is permitted a bed.
(c) (Gemara) Question: What is a Dargash?
(d) Answer #1 (Ula): A bed spread only for good luck, not for use.
1. Question #1 ((Mishnah): When giving the 1st consolation meal to a king (after he lost a relative), all sit on the ground, and the king sits on a Dargash.
i. You cannot say that this bed is never used, only when he starts mourning!
2. Answer (Ravina): We can say this! Regarding meat and wine - normally, he has them only if he wants - now, we give him!
3. Question #2 (Beraisa): They would not turn over the Dargash, they would leave it upright;
i. (Beraisa): Not only the mourner's bed is turned, but all his beds in the house are turned!

4. Answer: We can say, the law of a Dargash is the same as a bed special for vessels.
i. (Beraisa): There is no need to turn a bed special for vessels.
5. Question #3 (Beraisa - R. Shimon Ben Gamliel): It suffices to untie the loops of a Dargash, for then it falls.
i. A bed for good luck does not have loops!
(e) Answer #2 (Ravin): A bed consisting of a skin which is tied to the frame.
(f) Question: What is the difference between a bed and a Dargash?
(g) Answer #1 (R. Yirmiyah): The ropes of a bed are fastened on top of the frame; the ropes of a Dargash are fastened in the frame.
1. Question (Mishnah): A wooden bed or crib is susceptible to Tumah from the time it is rubbed with skin of a fish (to smooth it).
i. If the ropes are fastened on top of the frame - why bother smoothing it?
(h) Answer #2: Rather, by both, the ropes are fastened in the frame.
1. By a bed, the ropes pass through holes in the frame; in a Dargash, they pass through loops attached to the frame.
(i) (Rav Yakov Bar Acha): A bed that has poles jutting out at the head and foot - it suffices to stand it up on the head or foot.
(j) (R. Yehoshua Ben Levi): The law is as R. Shimon Ben Gamliel.
3) ONE WHO VOWS FROM A CITY OR HOUSE
(a) (Mishnah): One who vows from a city may enter its Techum (surrounding kilometer in which one may walk on Shabbos), he may not enter its Ibur (the surrounding 71 Amos);
(b) One who vows from a house may not enter the Agaf (threshhold) or further in.
(c) (Gemara): How do we know that the Ibur of a city is as the city?
(d) Answer (R. Yochanan): "When Yehoshua was in Yericho ..."
1. Question: What does this mean?
i. Suggestion: If it means, in the city itself - but it was closed off!
2. Answer: Rather, he was in its Ibur.
3. Suggestion: Perhaps he was in the Techum, and even this is considered being in the city!
4. Rejection: Regarding the Techum, it says "You will measure from outside the city".
(e) (Mishnah): One who vows from a house is only forbidden from the Agaf and further in.
(f) This implies, he is permitted everything outside!
(g) Question (Rav Mari - Mishnah): "The Kohen will leave the (leprous) house" - one might have thought, he goes home and closes it - "To the doorway".
1. One might have thought, he stands under the lintel and closes it - "From the house" - he must entirely leave the house.
i. He stands next to the lintel and closes it.
2. Question: How do we know, if he went home and closed it, or closed it while under the lintel, it has the law of being closed?
3. Answer: "He will close the house" - in any case.
(h) (The question is from the fact that under the lintel is considered as in the house, even if it is outside the Agaf).
(i) Answer: Normally, it is considered outside the house - by a leprous house, the Torah said that the Kohen must leave it entirely.
