Sukah 41

SUKA 36-56 (End of Maseches) have been dedicated by the wife and daughters of the late Dr. Simcha Bekelnitzky (Simcha Gedalya ben Shraga Feibush) of Queens N.Y. Well known in the community for his Chesed and Tzedakah, he will long be remembered.

1a) [line 22] MIKDASH - (a) Yerushalayim (RAMBAM, RIVEVAN Shekalim 3b); (b) the Beis ha'Mikdash (BARTENURA, VILNA GA'ON -- according to the Vilna Ga'on, "Mikdash" refers to the Beis ha'Mikdash and "Medinah" refers to all of the cities of Eretz Yisrael except for Yerushalayim - see MISHNAS ELIYAHU to Shekalim 5a DH k'Shem she'Hayu)
b) [line 22] MEDINAH - (a) Eretz Yisrael (RAMBAM, RIVEVAN Shekalim 3b, VILNA GA'ON); (b) in Yerushalayim (BARTENURA)

2) [line 25] YOM HA'NEF (CHADASH)
(a) Chadash is any grain that has not begun to take root until after the Korban ha'Omer is brought on the second day of Pesach. This grain may not be eaten until next year's Korban ha'Omer is brought (or when there is no Beis ha'Mikdash, until the day that it would have been brought), as it states in Vayikra 23:14 ("v'Lechem v'Kali v'Charmel Lo Sochlu ...").
(b) Many Rishonim rule that the prohibition of Chadash applies mid'Oraisa even in Chutz la'Aretz.

3) [line 27] "KI A'ALEH ARUCHAH LACH, UMI'MAKOSAYICH ERPA'ECH NE'UM HASH-M; KI NIDACHAH KAR'U LACH, TZIYON HI, DORESH EIN LAH" - "For I will make a cure for you; and I will heal you from your wounds, says HaSh-m; for they called you, 'Discarded!' [saying,] 'She is Tziyon -- no one cares about her!'"(Yirmeyahu 30:17)

7) [line 10] DARASH V'HISKIN - he expounded [the verse to prove that the entire day of the sixteenth of Nisan is forbidden by the Torah] and publicly decreed accordingly (i.e. he publicized the ruling so that people would not mistakenly eat produce from the new crop after midday, as they did when the Beis ha'Mikdash stood.)

8) [line 36] MATANAH AL MENAS L'HACHZIR SHEMAH MATANAH (a gift given on condition that it be returned after its use is a full-fledged gift)
(a) In many instances the Torah requires a person to *transfer ownership* of a certain item to another person (for example, giving Matenos Kehuah to a Kohen or transferring an item of value through which a sale is effected). In addition, there are many Mitzvos for which a person needs to *own* an item in order to fulfill the Mitzvah (such as the four species - that must belong to the person ("Lachem") at least on the first day of Sukos - and a garment that is obligated in Tzitzis).
(b) In such cases, the Amora'im question whether a gift given on the condition that it be returned is considered to fully belong to the recipient for the time that he retains it. (That is, can money given under this condition effect a Pidyon ha'Ben or is a Lulav given under this condition considered the possession of the recipient?)
(c) According to all opinions, if the gift was lost or the recipient does not return it, the transfer of ownership is revoked retroactively, since the condition was not fulfilled. The Rishonim add that when the recipient returns the gift, he must return it through a valid Ma'aseh Kinyan. Until this point it belonged entirely to him; therefore the gift does not return to the possession of the original owner without a full transfer of ownership (see Ketzos ha'Choshen 241:4 and Insights to Sukah 46:3).
