Sukah 40

SUKA 36-56 (End of Maseches) have been dedicated by the wife and daughters of the late Dr. Simcha Bekelnitzky (Simcha Gedalya ben Shraga Feibush) of Queens N.Y. Well known in the community for his Chesed and Tzedakah, he will long be remembered.

1) According to Raban Gamliel (in the Mishnah in Bikurim), an Esrog has the same Din as other trees as regards Orlah, Neta Revai and Shemitah.
What does this mean? What Din do other trees have?

2)

(a) How does one gauge vines and olive-trees for Ma'asros? What are the ramifications of this Halachah?

(b) Why do vegetables have a different Din regarding Ma'asros, than corn, wine and oil (which one is Chayav to Ma'aser min ha'Torah)?

(c) Then why does Raban Gamliel give an *Esrog* the same Din as *vegetables* as regards Ma'asros?

(d) What does Rebbi Eliezer say (in Bikurim) about an Esrog-tree?

3) Seeing as both Tana'im in the Mishnah in Bikurim consider an Esrog like any other tree as regards Shevi'is, on what basis does the Tana of *our* Mishnah give the Esrog the Din of a *seventh* year Esrog, and not of a *sixth*?

4)

(a) Would cane or vine-shoots have Kedushas Shevi'is, if they were gathered ...
  1. ... as animal food?
  2. ... firewood?
(b) A Lulav is not eaten (even by animals).
Then why does it have Kedushas Shevi'is? What is the source for this?

(c) Wood that is specifically used for lighting, gives benefit as it burns, and therefore has Kedushas Shevi'is.
Will this also apply to ordinary wood that one wishes to use for lighting?

5)
(a) Why does the Tana Kama of the Beraisa forbid using Shemitah-fruit for soaking flax or washing clothes?

(b) Rebbi Yossi permits it.
How does Rebbi Yossi explain "Lachem le'Ochlah"?

(c) On what grounds does he include washing clothes in "le'Ochlah" and preclude using them for medicinal purposes?

Answers to questions

40b---------------------------------------40b

6)

(a) Another Beraisa learns from "le'Ochlah" to preclude Melugma and Ziluf. Melugma means a type of cure, as in the previous Beraisa.
What is 'Ziluf'?

(b) Why must the author of this Beraisa be Rebbi Yossi, and not the Rabbanan? What would the Rabbanan have included in the list?

7)
(a) Rebbi Elazar requires Shemitah produce to be redeemed through a sale. What does Rebbi Yochanan say?

(b) Rebbi Elazar derives his Din from the juxtaposition of the Pasuk in Behar "ve'Chi Simkeru Mimkar la'Amisecha" and that of "bi'Shenas ha'Yovel ha'Zos".
What does Rebbi Yochanan learn from there?

(c) What is *'Avkah* shel Shevi'is'?

8)
(a) What does does Rebbi Yochanan learn from the Pasuk there "Ki Yovel Hi, Kodesh ... '?

(b) And what does Rebbi Elazar learn from that Pasuk?

9)
(a) If someone swaps fruit of Shemitah for meat, what happens to the fruit and to the meat when the time of 'Biur' arrives? Why is the Din here different than by other cases of Hekdesh?

(b) And if he then swapped the meat for fish what will happen to the meat and to the fish?

(c) Why should the Din here differ from the previous case? Why does the meat go out to Chulin, and not the fruit in the previous case?

(d) How does this Beraisa support Rebbi Elazar?

10)
(a) In another Beraisa that supports Rebbi Yochanan, Rebbi Meir permits the transfer of the Kedushah of both Shevi'is and Ma'aser Sheini on to any kind of animal, even if it is *alive*.
On what grounds do the Chachamim forbid transferring their Kedushah on to a *live* animal?

(b) What does Rava mean when he establishes their Machlokes by male animals? What will they hold by female animals?
