Yevamos 76

YEVAMOS 76, 77 - Dedicated by Eddie and Esther Turkel in prayer for a Refu'ah Shelemah to Yitzchak ben Lanah. May the Talmud Torah d'Rabim sponsored in his honor protect him and gain him a full and speedy recovery.

1) WHICH PROBLEMS CAUSE STERILITY

(a) Objection (Rav Papi): This makes no sense! Seed may only be cooked in its proper conduit (and he cannot have children)!
(b) (Rav Yehudah): If it was punctured and sealed - if when he has an emission, the seal tears, he is sterile and forbidden; if not, he is Kosher.
(c) (Rava): This cannot refer to a puncture below the crown - there, even if cut, he is Kosher!
1. Rather, the puncture is in the crown itself.
(d) (Rav Mari Bar Mar): If the crown was punctured and sealed - if when he has an emission, the seal tears, he is sterile and forbidden; if not, he is Kosher.
(e) Question (Rava Brei d'Rabah): How do we cause him to have an emission to check this?
(f) Answer #1 (Rav Yosef): We put warm barley bread by his anus.
1. Objection (Abaye): Is everyone like Yakov Avinu, who called Reuven "My first strength", because he never had an emission before that?!
(g) Answer #2 (Abaye): We pass colored women's clothing in front of him, and this causes him to have an emission.
(h) Objection (Rava): Is everyone like Barzilai ha'Giladi?!
1. (Rava): Rather, as Rav Yosef answered.
(i) (Beraisa): If it is punctured, he is forbidden, because the seed drips out; if it is sealed, he is Kosher, since he can have children.
1. This is a disqualification which can revert to Kashrus.
(j) Question: '*This*' - to exclude which case?
(k) Answer: To exclude a scab which developed over a bruise, which is not a proper sealing.
(l) Question (Rav Idi Bar Avin): How do we seal a puncture?
(m) Answer (Abaye): We cut around the puncture with barley; we rub the area with oil. We bring a big ant, have it bite the area, and cut off its head.
1. Only barley may be used - but iron would cause a bruise or inflammation.
2. This remedy will only help for a small puncture; by a big one, the sealing will peel off.
(n) (Rabah Bar Rav Huna): One who urinates through 2 openings is forbidden.
(o) (Rava): The law is not as he said, nor as his father.
1. (Rav Huna): Women that rub their genitals together are disqualified from Kehunah.
2. (Rava): Even R. Elazar, who says that extramarital relations make a woman a Zonah, only said this by a man; 2 women together is mere lewdness.
2) THE PROHIBITION OF A PETZU'A DAKA
(a) (Mishnah): A Petzu'a Daka or Crus Shafchah is permitted to a convert or freed slave; he is only forbidden to the congregation (of Yisrael) - "He will not enter the congregation of Hash-m".
(b) (Gemara) Question: A Petzu'a Daka Kohen - may he marry a convert or freed slave?
1. Does he retain his sanctity, and he is forbidden;
2. Or, he lost his sanctity, and he is permitted?
(c) Answer (Rav Sheshes - Beraisa): A Petzu'a Daka Yisrael may marry a Nesinah.
1. If he retains his sanctity - he would transgress "Do not intermarry with them"!
(d) Objection (Rava): That prohibition is not dependent on sanctity - it is because their children might serve idolatry!
1. The prohibition only applies while they are Nochrim - after conversion, the Torah permits them, only Chachamim decreed against them.
2. Chachamim only decreed by people that can have children.
3. Question: If so, a Mamzer, that can have children, should be forbidden!
i. (Mishnah): Mamzerim and Nesinim may intermarry!
4. Retraction (of statement 2): Rather, Chachamim only decreed by people of Kosher lineage.
(e) Rava retracted his objection (d).
1. (Rava): "Do not intermarry with them" applies after conversion - before this, marriage does not take effect!
(f) Question (Rav Yosef): "Shlomo married the daughter of Paro, King of Mitzrayim".
(g) Answer: He first converted her.
(h) Question: We did not accept converts in the days of David and Shlomo!
(i) Answer: We did not accept, because we suspected that they were only converting for wealth - Paro's daughter was already wealthy!

(j) Question: If she converted, she is a 1st generation Mitzris, and is forbidden!
1. Suggestion: Perhaps the Mitzrim perished, and other nations settled in Mitzrayim (and Paro's daughter was from them).
2. Rejection (Beraisa): Minyamin my colleague was a Mitzri Rishon (1st generation Mitzri); he married a Mitzris Rishonah, and planned to marry his son to a Mitzris Shniyah (2nd generation Mitzris), so his grandchildren would be permitted.
(k) Answer (Rav Papa): There is no question from Shlomo - he did not marry her!
1. "The forbidden nations ... Shlomo clung to love (not marriage)".
(l) Question: But it says, "He married her"!
(m) Answer: Because he loved her excessively, the verse calls it marriage.
(n) Question (Ravina): The Mishnah teaches, 'A Petzu'a Daka or Crus Shafchah is permitted to a convert or freed slave' - implying, he is forbidden to a Nesinah (this contradicts the Beraisa (c))!
(o) Counter-question (Rav Ashi): The end of the Mishnah says, 'He is only forbidden to the congregation (of Yisrael)' - implying, he may marry a Nesinah!
1. Since the implications contradict each other, we cannot infer how the Mishnah rules.
3) THE PROHIBITION OF AMONIM AND MOAVIM
(a) (Mishnah): Amonim and Moavim are forever forbidden, but females are permitted immediately;
(b) Mitzrim and Adomim are forbidden until 3 generations, males and females; R. Shimon permits females immediately.
1. R. Shimon: This is a Kal v'Chomer - when the males are forbidden forever, the females are permitted immediately; when the males are only forbidden until 3 generations, all the more so females are permitted immediately!
2. Chachamim: If you received this law on tradition, we accept; if not, we can challenge your Kal v'Chomer.
3. R. Shimon: I have a tradition.
(c) (Gemara) Question: What is the source that female Amonites and Moavites are permitted?
(d) Answer (R. Yochanan): "Shaul asked: 'Who is this youth (David)?'
(e) Avner: I do not know."
1. Objection: Shaul certainly knew who David was - "He loved him greatly, he carried his vessels"!
2. Answer: Shaul was asking who David's father was.
3. Objection: Shaul certainly knew who David's father was - "The man was a sage, very well known ...".
i. (Rav): This is Yishai, who was appointed over 600,000!
4. Answer: Rather, Shaul was asking if David comes from Peretz or from Zerach.
i. If he comes from Peretz, he will be king, since a king Poretz (breaks fences) to make a path;
ii. If he comes from Zerach, he is merely important.
(f) Why did Shaul inquire about David?
(g) Answer: "Shaul clothed David in his garments, as his measure"; but Shaul was "From his shoulder and above, taller than the whole nation"!
(h) Doeg ha'Edomi: Before asking if he is fit for kingship, ask if he is fit to marry into Yisrael!
1. Question: Why shouldn't he be?
2. Answer: He descends from Rus the Moavis.
(i) Avner: But we learned, an Amoni is forbidden, not an Amonis; a Moavi, not a Moavis!
(j) Doeg: If so, you should say a Mamzer is forbidden, not a Mamzeres!
(k) Avner: "Mamzer" - Mum Zar (a foreign blemish), which applies equally to women.
(l) Doeg: If so, you should say a Mitzri is forbidden, not a Mitzris!
(m) Avner: The prohibition of Moabites is different, since the Torah specified the reason - "Because they did not go out to greet you with bread and water".
1. It is the way of men to go out to greet, not of women.
(n) Doeg: The men should have gone out to greet the men, and the women to greet the women!
1. Avner was silent.
(o) "The king said, ask whose son is this youth".
(p) Question: Before, it says Na'ar (youth) - here, why does it say ELeM (youth)?
(q) Answer: This is a hint - Shaul said, this law NisALMah (is hidden) from you - go ask in the Beis Medrash.
1. He asked they said, an Amoni is forbidden, not an Amonis; a Moavi, not a Moavis.
