Yevamos 46

YEVAMOS 46-50 - Ari Kornfeld has generously sponsored the Dafyomi publications for these Dafim for the benefit of Klal Yisrael.

1)

(a) Rav Chama bar Guri'ah Amar Rav says that if someone buys an Eved Kena'ani from a Nochri and the Eved has in mind to convert as he Tovels, he goes free.
Why is that?

(b) Rava holds that Hekdesh, Chametz and Shichrur remove the Shibud (right to claim).
What does he mean by ...

  1. ... Hekdesh? Which kind of Hekdesh does not remove the Shibud?
  2. ... Chametz?
  3. ... Shichrur?
(c) What do we infer from the story cited by the Beraisa, where B'luria'h the Giyores' slaves Toveled before she did, and the Chachamim ruled that they were free?

(d) How did Rava reconcile Rav Chama bar Guri'ah Amar Rav with the Beraisa?

2)
(a) What does Rav Ivya learn from the Pasuk in Behar "ve'Gam mi'B'nei ha'Toshavim ha'Garim Imachem *Meihem Tiknu* Eved ve'Amah" with regard to the difference between acquiring an Eved Kena'ani from a Nochri (second-hand) and acquiring him from himself (first-hand)?

(b) What do we learn from the Pasuk "O le'Eiker Mishpachas Ger"?

(c) How does Rav Ivya reconcile this with the previous Derashah ('O Heim Mikem')?

(d) What Kashya does Rav Acha ask on Rav Ivya (for which we have no answer)?

3)
(a) What does Shmuel say one must do when Toveling an Eved? Why is this necessary?

(b) What did Rav Ashi tell Ravina and Rav Acha B'rei de'Rava when he handed Menimin his slave to them to Tovel on his behalf?

(c) During the Tevilah, they tied a rope around his neck, which they tightened and loosened.
Why did they need ...

  1. ... to tighten the rope?
  2. ... to loosen it?
(d) What did they do the moment his head emerged from the water?
4)
(a) What did certain members of Papa bar Aba's household used to do when they found people who had not paid their head-tax? Who were these people, Jews or Nochrim?

(b) What She'eilah did Rav Papa ask Rava concerning them?

(c) In his answer, Rava quoted Rev Sheishes.
What did Rav Sheishes say? What did Rava rule?

5)
(a) Rebbi Chiya bar Aba arrived in Gavla. He was silent when he saw some of the women pregnant from Geirim who had circumcised but not Toveled, that they used wine that had been poured out by Nochrim and that they ate Turmus-beans that had been cooked by Nochrim.
Why did Rebbi Chiya bar Aba believe ...
  1. ... that their children were not Mamzeirim?
  2. ... that their wine was not Yayin Nesech?
(b) On what grounds did Rebbi Yochanan instruct him to go back and tell the people of Gavla that ...
  1. ... their children were Mamzeirim?
  2. ... that their wine was Yayin Nesech?
  3. ... that their Turmus-beans were forbidden?
(c) Considering that Turmus-beans are inedible when they are raw, why did he forbid them only because they were not B'nei-Torah, and not intrinsically?
6)
(a) On what does ...
  1. ... Rebbi Eliezer base his contention that a Ger requires Milah but not Tevilah?
  2. ... Rebbi Yehoshua base *his* contention that a Ger requires Tevilah and not Milah?
(b) What do the Rabbanan say?

(c) We ask why Rebbi Eliezer does not want to learn from the Imahos (that Tevilah alone will suffice by a Ger).
Why can we not answer that Rebbi Eliezer declines to learn what is possible from what is impossible?

Answers to questions

7)

(a) We therefore conclude that Rebbi Eliezer agrees with Rebbi Yehoshua that Tevilah alone will suffice for Geirus.
Then in which point do Rebbi Eliezer and Rebbi Yehoshua argue?

(b) On what basis does Rebbi Yehoshua disagree with Rebbi Eliezer? Why is there no proof from the Avos who left Egypt, that Milah without Tevilah is sufficient for Geirus?

(c) Initially, we present Rebbi Yehoshua's source as being the Pasuk in Yisro "Lech el ha'Am ve'Kidashtam ha'Yom u'Machar, ve'Chibsu Simlosam". How do we try to prove from there that there must have been Tevilah?

(d) How do we refute this proof?

8)
(a) How do we prove conclusively (according to Rebbi Yehoshua) that there must have been Tevilah from the Pasuk in Mishpatim "va'Yikach Moshe es ha'Dam va'Yizrok al ha'Am"?

(b) And from where does Rebbi Yehoshua know that the Imahos Toveled before Matan Torah (see Tosfos DH 've'Rebbi Yehoshua')?

9) Rebbi Chiya bar Aba Amar Rebbi Yochanan rules that a Ger requires Milah and Tevilah.
Why is it not obvious, due to the principle 'Yachid ve'Rabim, Halachah ke'Rabim'?

10)

(a) What does Rebbi Yehudah mean when he says in a Beraisa ...
1. ... that someone who claims that he made Milah (for Geirus) but not Tevilah, 'Matbilin Oso u'Mah be'Kach'?
2. ... 'Lefichach, Matbilin Ger be'Shabbos'? Assuming that he already made Milah previously, and (in his opinion, a Ger does not require both Milah and Tevilah), what could possibly be wrong with Toveling on Shabbos (seeing as this does not constitute a Tikun [he does not achieve anything])?
(b) What does Rebbi Yossi mean when, commenting on Rebbi Yehudah's first ruling, he says 'Ein Matbilin'? Why not?

(c) And what does he mean when he says 'Ein Matbilin (Ger be'Shabbos)? Seeing as he holds that Tevilah alone is not sufficient, but Milah is required too, why is it not obvious that if he made Milah before Shabbos, that he cannot make Tevilah on Shabbos (since that constitutes a Tikun)?

11)
(a) According to Rav Safra, Rebbi Chiya bar Rebbi, Rebbi Oshaya b'Rivi and Rebbi Oshaya b'Rebbi Chiya were all present when a Ger who had had Milah but not Tevilah appeared before them one night. What instructions did they give him?

(b) Which two Halachos (besides the fact that Tevilas Ger cannot be performed by night) do we learn from this episode?

(c) Why did they not also include in the list that Geirus requires expert Dayanim?

(d) From where does Rebbi Yochanan learn that Geirus requires three?
