9) R. AKIVA'S WIFE

(a) She replied, 'I would want him to stay another 12 years'!
(b) R. Akiva: She desires that I keep learning!
(c) R. Akiva learned for another 12 years. He returned home with 24,000 Talmidim.

1. His wife heard that he was returning, and went to greet him.
2. Neighbors: You should borrow better clothes to greet him!
3. His wife: "A Tzadik knows the soul of his animal."
4. When she reached him, she bowed to the ground and kissed his feet. R. Akiva's servant started to dispel her.
5. R. Akiva: Leave her - my Torah and yours is due to her.
6. Her father heard that a great Chacham came. He went to see him, hoping to annul his vow.
7. R. Akiva: Did you vow, thinking to forbid him, even if he will be a great man?
8. Ben Kalba Savua: Even if he would learn one chapter, or one law, I did not intend to vow.
9. R. Akiva: I am your son-in-law!
10. His father-in-law bowed and kissed his foot, and gave half his money to his daughter.

(d) R. Akiva's daughter did similarly with Ben Azai.

1. A sheep goes after a sheep - as the mother, so does the daughter.
2. Rava sent his son Rav Yosef to learn for 6 years. After 3 years, his son decided to see his family, on Erev Yom Kipur.
3. Rava heard that he was coming; he took a weapon and went to greet him.
4. Version #1 (Rava): You remembered your harlot (some texts - your spouse)!
5. Version #2 (Rava): You remembered your dove!
6. They quarreled, and neither ate the pre-fast meal.

(a) (Mishnah): A woman who rebels on her husband - her Kesuvah is reduced by 7 Dinarim every week; R. Yehudah says, 7 Trap'ikin;
(b) This continues until her Kesuvah is finished; R. Yosi says, we decrease indefinitely - perhaps she will inherit money, and he will collect from it;
(c) Similarly, a man who rebels on his wife - her Kesuvah is increased by 3 Dinarim every week; R. Yehudah says, 3 Trap'ikin.
(d) (Gemara) Question: Regarding what is she rebelling?
(e) Answer #1 (Rav Huna): From having relations.
(f) Answer #2 (R. Yosi Bar Chanina): From work.
(g) (Mishnah): Similarly, a man that rebels on his wife ...

1. We understand, according to Rav Huna - (similarly, if he refuses to have relations).
2. Question: According to R. Yosi Bar Chanina - is he obligated to work for her?!
3. Answer: Yes - he refuses to feed her.
4. Question: But Rav taught, a man that refuses to feed his wife must divorce her and pay her Kesuvah!
5. Answer: We first consult with him (and until he divorces her, we add to her Kesuvah).

(h) Question (Beraisa): The law of rebellion applies in all these cases - an engaged wife, fully married, even if she is Nidah, even if she is sick, even a widow awaiting Yibum.

1. We understand, the opinion that says, she is rebelling from work.
2. The opinion that says, she rebels from relations - a Nidah cannot have relations in any case!

(i) Answer: Without her rebellion, her husband was comforted as one that has bread in his basket (later, she will be permitted); now, he is as one whose basket is empty.

1. We understand, the opinion that says, she is rebelling from relations, this applies even when she is sick.

2. Question: The opinion that says, she rebels from work - if she is sick, she cannot work anyway!
3. Answer: All agree, rebellion from relations is rebellion.

i. They only argue if rebellion from work is *also* rebellion.

(a) (Beraisa): Our Rabbis reconsidered and voted to announce for 4 consecutive Shabbosos that she is rebelling; Beis Din sends her a message, 'Know, even if your Kesuvah is 100 Maneh, you will lose it all';
(b) The law of rebellion applies in all these cases - an engaged wife, fully married, even if she is Nidah, even if she is sick, even a widow awaiting Yibum.
(c) Question (R. Chiya Bar Yosef): Can a Nidah have relations (that she is considered a rebel)?
(d) Answer (Shmuel): There is no comparing one with bread in his basket to one lacking bread in his basket.
(e) (Rami Bar Chama): We only announce about her in Shul and Beis Medrash.

1. (Rava): The Beraisa supports this - it says, 4 consecutive Shabbosos (when all are in Shul or Beis Medrash).

(f) (Rami Bar Chama): Beis Din sends her 2 messages - 1 before the announcements, and 1 after them.
(g) (Rav Nachman Bar Rav Chisda): The law is as our Rabbis.
(h) (Rava): That is foolish!
(i) Question (Rav Nachman Bar Yitzchak): What is foolish about it? I said it to Rav Nachman Bar Rav Chisda, in the name of a great man - R. Yosi Bar Chanina!
(j) Question: Whom does Rava hold as?
(k) Answer: As Rav Sheshes.

1. (Rava, citing Rav Sheshes): The law is, we consult with her.
2. (Rav Huna Bar Yehudah, citing Rav Sheshes): The law is, we do not consult with her.

(l) Question: What is the case of a rebel?
(m) Answer #1 (Ameimar): I desire (to stay married to) him, I just want to pain him.

1. But if she said, he is repulsive to me, we do not force her.

(n) Answer #2 (Mar Zutra): (Even in this case,) we force her.

1. There was a case, and Mar Zutra forced her to stay married; she gave birth to R. Chanina of Sura.
2. This is no proof that Mar Zutra's law is correct - Heaven helped!

(o) Rav Zvid's daughter-in-law rebelled; her husband had possession of a silk garment she brought into the marriage.

1. Version #1 - Ameimar, Mar Zutra and Rav Ashi: One that rebels forfeits the remnants of property she brought into the marriage.
2. Objection (Rav Gamda): Because Rav Zvid is a great man, you flatter him (to pervert the ruling to favor his son)?!

i. (Rav Kahana): Rava never resolved, whether she forfeits the remnants (therefore, she should keep what is in her possession)!

3. Version #2 - Ameimar, Mar Zutra, and Rav Ashi: One that rebels does not forfeit the remnants of property she brought into the marriage.
4. Objection (Rav Gamda): Because Rav Zvid is a great man, you pervert the ruling against him?!
