12) LAWS OF A REBEL

1. (Rav Kahana): Rava never resolved whether or not she forfeits the remnants.
i. Therefore, whatever she seized, we do not take from her; what she did not seize, we do not give to her!
(b) We make her wait 12 months before he gives her a Get; during this time, she is not fed.
(c) (Shmuel): We write a letter of rebellion against an engaged girl, but not against a Shomeres Yavam (a Yevamah waiting to do Yibum).
(d) Question (Beraisa): Whether she is engaged, married, even Nidah, even sick, even Shomeres Yavam ...
(e) Answer #1: When the Yavam demands to do Yibum, we write; when she demands, we do not write.
1. Objection: If so, it should say, we do/not write *for* an engaged girl/Yevamah!
2. Answer: We can say, that is indeed what Shmuel said.
3. Question: Why don't we write for a Yevamah - because she is not commanded to have children - the same applies to an engaged girl!
i. We must say - her claim is, she wants children to support her in her old age and to bury her when she dies - but a Yevamah has the same claim!
(f) Answer #2: In both the Beraisa and Shmuel's teaching, the Yavam demands; in the Beraisa, he demands to do Chalitzah; in Shmuel's teaching, he demands to do Yibum.
1. This is as R. Pedas: If he demands Chalitzah, we honor his claim; if he demands Yibum, we ignore his claim.
2. Question: Why do we distinguish?
i. When he demands Yibum, we tell him to marry a different girl - we can also tell him this when he demands Chalitzah!
3. Answer: He can say, people will not give me (their daughters) the whole time she is Shomeres Yavam.
4. Question: But he can also say this when he demands Yibum!
(g) Answer #3: In both cases, he demands to do Yibum; the Beraisa is as the 1st Mishnah, Shmuel is as the later Mishnah.
1. (Mishnah): At first, when people intended for the Mitzvah of Yibum, this was preferable to Chalitzah. Nowadays, that people do not intend for the Mitzvah, Chachamim say that Chalitzah is preferred.
13) HOW MUCH IS TAKEN FROM OR ADDED TO THE KESUVAH
(a) Question: How much is a Trape'ikin?
(b) Answer (Rav Sheshes): 1 Istira.
(c) Question: How much is an Istira?
(d) Answer: Half a Zuz.
1. (Beraisa - R. Yehudah): 3 Trape'ikin, which are 9 Ma'in, 1 1/2 Ma'in per day.
(e) Question (R. Chiya Bar Yosef): When she reels, we deduct from her Kesuvah corresponding to all 7 days of the week, including Shabbos - when he rebels, why do we only add to her Kesuvah for 6 weekdays, but not for Shabbos?
(f) Answer (Shmuel): When we subtract from her Kesuvah, it does not appear as wages for Shabbos; when we add to her Kesuvah, it appears as wages for Shabbos.

(g) Question (R. Chiya Bar Yosef): Why is a wife that rebels punished more than a husband that rebels?
(h) Answer #1 (Shmuel): We see by harlotry - men hire women (they desire relations more).
(i) Answer #2 (Shmuel): A man's desire is external, a woman's is internal (so she does not suffer shame).
14) MINIMAL FOOD ONE MUST SUPPLY TO HIS WIFE
(a) (Mishnah): One that feeds his wife through an intermediary must supply at least this much every week:
1. 2 Kabim of wheat, or 4 Kabim of barley;
i. R. Yosi says, only R. Yishmael says this, since he lived close to Edom.
2. 1/2 Kav of legumes;
3. 1/2 *Log* of oil;
4. A Kav of dried figs, or a Maneh of pressed figs;
i. If he cannot give these, he gives other fruits.
(b) He provides her with a bed, and mattress;
(c) He gives her a kerchief for her head and a belt;
(d) He gives her shoes every festival;
(e) He gives her clothing worth 50 Zuz each year; he does not give new clothing in summer, nor worn clothing in winter - rather, he gives 50 Zuz worth of new clothing in winter, and she wears the remnants in summer, and the remnants are hers;
(f) He gives her a silver Ma'ah each week for her needs;
(g) She eats with him every Shabbos night;
(h) If he does not give her a Ma'ah each week, she keeps her (excess) earnings;
(i) Each week, she is required to spin 5 Sela'im of Shesi threads (of wool) as measured in Yehudah, which is 10 Sela'im by the Galil measure;
1. Or, she can spin 10 Yehudah-Sela'im of Arev threads, which equals 20 Galil-Sela'im.
(j) If she was nursing, her workload is reduced and her rations are increased;
(k) This all applies to the poorest man in Yisrael - each man must increase according to his standing.
(l) (Gemara) Question: The Mishnah is not as R. Yochanan Ben Brokah, nor as R. Shimon!
1. (Mishnah - Question): What quantity constitutes 2 meals (for each person participating in Eruv Techumim)?
2. R. Meir says, (the amount of bread he eats in) 2 weekday meals; R. Yehudah says, in 2 Shabbos meals.
i. Both intend to be lenient.
3. R. Yochanan Ben Brokah says, a loaf bought for a Pundiyon when 4 Sa'in of wheat cost a Sela;
4. R. Shimon says, 2/3 of a loaf, and the loaf is 1/3 of a Kav.
5. Half of this amount is the size of a meal regarding a plagued house (if one stays in a plagued house long enough to eat this much, the clothes he is wearing become Tamei for 7 days).
6. Eating 1/4 of this amount of Tamei food disqualifies one from eating Trumah (until he immerses);
7. Food 1/8 of this amount can impart (some explain, can become Huchshar (prepared) to receive) Tumah.
i. The Mishnah cannot be R. Yochanan Ben Brokah - since he says 1/2 Kav suffices for 2 meals, 2 Kabim are only 8 meals (and she must eat 14 meals per week)!
ii. The Mishnah cannot be as R. Shimon - since he says 2/9 Kav makes 2 meals, 2 Kabim are 18 meals!
(m) Answer #1: The Mishnah is as R. Yochanan Ben Brokah - our calculation was imprecise, because the price of bread is more than the price of wheat!
1. (Rav Chisda): 1/3 of the price of bread is the grocer's profit.
i. Question: (According to this, 1/3 Kav makes 2 meals) - still, 2 Kabim are only 12 meals!
ii. Answer: She eats with him on Shabbos night, from his food.
iii. Objection #1: This only applies to the opinion that "eats" is literal; it does not answer for the opinion that it is a euphemism for relations!
iv. Objection #2: Even according to the former opinion - this only accounts for 13 meals!
2. Retraction: Rather, we rely on this teaching of Rav Chisda: 1/2 the price of bread is the grocer's mark-up.
3. Question: Rav Chisda contradicts himself!
4. Answer: When the grocer supplies the firewood, the mark-up is 1/2; when the buyer gave the wood, the mark-up is 1/3.
5. Question: (If so, 1/4 Kav wheat makes 2 meals) - 2 Kabim are 16!
i. Suggestion: Our Mishnah is as R. Chidka, who says that a person must eat 4 meals on Shabbos.
6. Rejection: No, our Mishnah can be as Chachamim - the extra meal is for guests.
(n) Answer #2: Based on this, we can say that our Mishnah is as R. Shimon - the extra meals are for guests!
(o) (Mishnah): R. Yosi says, only R. Yishmael apportioned barley ...
(p) Question: Is Edom the only place where people eat barley?!
(q) Answer: R Yosi says, only R. Yishmael apportioned twice as much barley as wheat, since barley of Edom is bad.
(r) (Mishnah): He gives her 1/2 Kav of legumes ...
1. We did not teach, he gives her wine -this supports R. Elazar.
